Welcome to the settlement website for the Gentiva Securities Litigation (the “Action”).

The purpose of this website is to inform you of the pendency of this class action and the proposed Settlement of the Action (the “Settlement”)1 and of the hearing to be held by the Court to consider the fairness, reasonableness, and adequacy of the Settlement as well as counsel’s application for fees, costs, and expenses. The Notice describes the rights you may have in connection with your participation in the Settlement, what steps you may take in relation to the Settlement and this class action, and, alternatively, what steps you must take if you wish to be excluded from the Settlement and this Action.

If approved by the Court, the settlement will provide a $6.5 million cash settlement fund for the benefit of eligible investors.

The Settlement resolves claims to persons and entities who purchased or otherwise acquired Gentiva Health Services, Inc. publicly traded common stock (“Gentiva Securities”) from July 31, 2008 to October 4, 2011, inclusive, and suffered alleged damages as a result.

If you are a member of the Class, your legal rights are affected whether you act or do not act.

The Court granted final approval of the Settlement on Thursday, October 1, 2015.

SUBMIT A CLAIM FORM BY AUGUST 25, 2015 The only way to get a payment. Proof of Claim and Release forms (“Proof of Claim”) must be postmarked or submitted online on or before August 25, 2015.
EXCLUDE YOURSELF BY AUGUST 21, 2015 Get no payment. This is the only option that allows you to ever be part of any other lawsuit against the Defendants or any other Released Persons about the legal claims in this case. The deadline to exclude yourself from the Settlement has passed.
OBJECT BY AUGUST 21, 2015 Write to the Court about why you do not like the Settlement, the Plan of Distribution, and/or the request for attorneys’ fees, costs, and expenses. The deadline to object to the Settlement has passed.
GO TO A HEARING ON SEPTEMBER 11, 2015 The Court approved the Settlement after the Hearing on October 1, 2015.
DO NOTHING Get no payment. Give up your rights.
